Monthly $1,000 Drawing Rules OFFICIAL RULES — NPD MONTHLY SWEEPSTAKES NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE 1) ENTRY PERIOD: The Monthly Sweepstakes ('Sweepstakes') begins at 12:00:00 AM Eastern Standard Time ('EST') the first day of each calendar month and ends at 11:59:59 PM EST on the last day of the same month (each a 'Sweepstakes Period'), beginning on February 23, 2009 and continuing until terminated. The NPD Group Inc. ('Sponsor') in its sole discretion may terminate the Sweepstakes by posting notice on its website (www.npdor.com) during any calendar month. By posting such notice the Sweepstakes will end on the last day of that month at 11:59:59 PM EST. 2) HOW TO ENTER: Registered members of NPD Online Research (NPDOR) will receive one (1) entry when they complete and submit the survey attached to these rules online by . Changes to answers of completed surveys will not qualify for additional entries. Entries will be entered into the monthly drawing corresponding to the month in which the survey was initially completed and submitted online. The number of entries by an entrant may not exceed the number of surveys completed and submitted by that entrant during any Sweepstakes Period. Example: If a member completes and submits 1 eligible survey on June 15, 2009 and a 2nd different eligible survey on June 20, 2009 the member will receive 2 entries in the June 2009 Sweepstakes drawing. In the event of a dispute as to the identification of the person submitting an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at time of entry. 'Authorized account holder' is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. 3) PRIZES: Five (5) prizes will be awarded per Sweepstakes, each consisting of a check in the amount of $1,000 (USD). Winners are responsible for payment of all taxes, custom duties and fees on prize and for any other expenses relating to the acceptance and use of the prize not specified herein. No substitution or transfer of prizes permitted. Limit 1 prize per person per Sweepstakes. Total value of all prizes: $5,000USD. 4) MONTHLY PRIZE DRAWING: For each Sweepstakes Period, five (5) potential winners will be randomly selected from among all eligible entries received for that particular month in a drawing held on or about thirty five (35) days following the last day of the relevant month. Example: The June 2009 drawing will take place on or about August 5, 2009. Entries from any monthly drawing will not 'roll-over' into subsequent monthly drawings. The odds of winning depend upon the total number of eligible entries received during each Sweepstakes Period. The Sponsor has contracted with Marden-Kane Inc., an independent third party judging organization, to oversee the administration of this Sweepstakes. Marden-Kanes decisions are final. The only information that is shared with Marden-Kane is the date the survey was submitted, member e-mail address and language preference for the sole purposes of winner selection, notification, and the fulfillment of prizes. This information is kept strictly confidential and is NEVER sold to anyone outside of NPD. By entering, you (and your parents and legal guardians if you are a minor) agree to be bound by these official rules ('Official Rules') and the decisions of Sponsor and judges which are final and binding in all matters relating to this Sweepstakes. Prize drawings will take place at Marden-Kane's, Manhasset, NY office. Potential winners will be notified by e-mail within five (5) business days of each drawing. If potential winner is a Canadian resident, he/she will also be required to correctly answer a timed, 4-step arithmetic skill-testing question in order to be confirmed as a winner and receive a prize. Quebec residents may submit any dispute regarding the conduct and awarding of a prize in this Sweepstakes to the Regie Des Alcools, Des Courses Et Des Jeux. If Sponsor is unable to contact potential winner(s) by e-mail, or if any potential winner fails to respond to the prize notification (and, in the case of residents of Canada, the skill-testing question) within fourteen (14) days of initial issuance of notification or if any potential winner fails to comply with any of the requirements stated herein, an alternate potential winner will be selected through another random drawing conducted by judges. Potential winners will be e-mailed and may be required to fill out an affidavit of eligibility/publicity and liability release, and return same, properly executed, to Sponsor which Sponsor must received within fourteen (14) days of initial e-mail notification. By accepting a prize, winner consents to the use of his/her name and place of residence for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. Allow 2-3 weeks after verification of winner status for the receipt of prize check by mail. If, for any reason this Sweepstakes is not capable of running as planned or because of an infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Sponsor which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right in its sole discretion to disqualify any entrant or to modify, terminate or suspend, in whole or in part, the Sweepstakes. Should the Sweepstakes be modified, terminated or suspended notice will be posted on the NPD Online Research website. No responsibility is assumed by 'Releasees' as defined below and entrants waive all claims for lost, late, incomplete, damaged, or misdirected surveys which will not qualify for entry, or for any problems or technical malfunction of any telephone/computer network or lines, telephone/computer equipment, software, failure of any e-mail service or any combination thereof including without limitation any damage to entrant's or any other person's computer resulting from completion of a survey or participation in this Sweepstakes. Entries generated by script, macro or other automated means will be void. All surveys and other entries become the property of the Sponsor and will not be acknowledged or returned. Any attempt to damage the NPDOR website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves right to prosecute violators to the fullest extent allowable by law. 5) ELIGIBILITY: This Sweepstakes is open to registered NPD Online Research  members 13 years of age or older at time of entry that have completed and submitted the respective surveys. This Sweepstakes is not open to residents of Maine under the age of 18. The prize check will be issued in the winner's name. This Sweepstakes is not open to employees of Sponsor or its affiliates, licensees, parents, franchisees, subsidiaries, advertising or promotion agencies or members of the immediate family or household of each. For purposes of clarification, 'immediate family' means parents, children, siblings and spouses, regardless of where they reside. In addition, this Sweepstakes is not open to individuals who voluntarily unsubscribe from either NPDOR before the applicable drawing date. By participating in the Sweepstakes, entrants agree to release and hold harmless Sponsor and its affiliates, licensees, parents, franchisees, subsidiaries, advertising and promotion agencies and their respective employees, officers, directors, shareholders, successors and assigns (collectively 'Releasees' from any and all liability for any injuries, losses or damage of any kind which may arise in connection with this Sweepstakes or the acceptance and/or use of any prize. Void where prohibited. Any issues concerning the validity, interpretation or enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor, shall be governed by and construed in accordance with the laws of the State of New York, USA, without giving effect to any conflict of law rules which might find otherwise. The Sweepstakes is subject to all applicable federal, state, provincial, municipal and local laws and regulations. 6) WINNER'S LIST: The winners for this Sweepstakes will be posted on the NPD Online Research web site (http://www.npdor.com/english/winners.asp ).
